How Does Bail Work in Texas?
An individual undergoes a booking process lasting for an hour or two in a local law enforcement in the city if they were arrested for a crime. After given a court date to settle their charges, they are then incarcerated to a jail. Alternatively, they can also choose to be released from jail through posting bail. Bail can be thought of as enticement for a jailed individual to appear in court on the given court date once released.
There are three release options available: release on own recognizance, cash bail, or surety bond.
To be released on your own recognizance, the defendant needs to sign a written promise that they will appear on court when they are needed to. RORs only need to be assured that the defendant will not commit other offenses under ROR, and do not need bail to be posted.
