How Does Bail Work in Texas?
In the instance that someone is charged with a crime, a booking process, lasting for around an hour or two, occurs in a local law enforcement, commonly the police department in the city. They are then brought to jail when they are given a court date to settle their charges. They are also given an option to be released from jail, with three options readily available, including bail. Bail can be thought of as enticement for a jailed individual to appear in court on the given court date once released.
There are three release options available: release on own recognizance, cash bail, or surety bond.
To be released on your own recognizance, the defendant needs to sign a written promise that they will appear on court when they are needed to. RORs only need to be assured that the defendant will not commit other offenses under ROR, and do not need bail to be posted. However, RORs are only given to less serious cases, and if the petition for an ROR is rejected, only the bail options are then available.
Cash bails require the defendant to pay a certain amount of cash in full to the court, before getting released. The cash is held by the court and returned once the defendant has completed his court appearances. Cash bails, though, cost a lot of money, thus many people choose the surety bond option.
Surety bonds require bail bonds agents, the ones who will do the bail, to be paid a 10% premium. This 10% fee is non-refundable, and cannot be returned even after the defendant completes his court appearances, which is how bail bonds agents earn. On the good side, these agents can be paid in a variety of ways, from credit cards to collateral, and they are also responsible for ensuring the defendant appears in court. However, at the occasion that the defendant fails to appear, the entire amount which the agents spent, from the court bails to other miscellaneous fees must be paid in full.
