How Does Bail Work in Texas?
An individual undergoes a booking process lasting for an hour or two in a local law enforcement in the city if they were arrested for a crime. They are then brought to jail when they are given a court date to settle their charges. However, they can also opt to be released from jail by posting bail, among other release options. Bail is specially designed as an incentive for the individual to appear in court on the assigned court date.
There are three release options available: release on own recognizance, cash bail, or surety bond.
The first option, release on own recognizance or ROR, requires the defendant to make a written promise to appear on court when he is required to. RORs only need to be assured that the defendant will not commit other offenses under ROR, and do not need bail to be posted. RORs, however, are only granted to less serious misdemeanors, and the bail options are the only ones available if the petition for an ROR is rejected.
Cash bails require the defendant to pay a certain amount determined by the judge so that they can be released. This amount is held by the court and then refunded to the defendant if they complete the required court appearances. The downside is that cash bails are usually exorbitant, thus most people opt for a surety bond.
Surety bonds require bail bonds agents, the ones who will do the bail, to be paid a 10% premium. This 10% fee is non-refundable, and cannot be returned even after the defendant completes his court appearances, which is how bail bonds agents earn. The fee is also payable through credit cards and collateral, among other possible ways, and bail bonds agents are responsible for the defendant to appear on court. If the defendant fails to appear on court on the court date, the entire amount which the agents paid for bail must be paid.
