How Does Bail Work in Texas?
An individual undergoes a booking process lasting for an hour or two in a local law enforcement in the city if they were arrested for a crime. They are given a date when they can settle their charges, and before then, they are brought to jail. They are also given an option to be released from jail, with three options readily available, including bail. Bail can be considered as an incentive for a person released from jail to return for court appearances.
There are three release options available: release on own recognizance, cash bail, or surety bond.
The first option, release on own recognizance or ROR, requires the defendant to make a written promise to appear on court when he is required to. RORs only need to be assured that the defendant will not commit other offenses under ROR, and do not need bail to be posted. RORs, however, are only granted to less serious misdemeanors, and the bail options are the only ones available if the petition for an ROR is rejected.
Cash bails require the defendant to pay a certain amount of cash in full to the court, before getting released. The cash is held by the court and returned once the defendant has completed his court appearances. However, these are costly and expensive; thus, most people opt for a surety bond.
Surety bonds are arranged by bail bonds agents, who require a 10% premium to be paid. This 10% fee is non-refundable, and cannot be returned even after the defendant completes his court appearances, which is how bail bonds agents earn. The fee is also payable through credit cards and collateral, among other possible ways, and bail bonds agents are responsible for the defendant to appear on court. However, at the instance that the defendant fails to appear, the entire amount costed by the bail bonds agent for bail must be paid.
