How Does Bail Work in Texas?
In the instance that someone is charged with a crime, a booking process, lasting for around an hour or two, occurs in a local law enforcement, commonly the police department in the city. After given a court date to settle their charges, they are then incarcerated to a jail. However, they can also opt to be released from jail by posting bail, among other release options. Bail can be considered as an incentive for a person released from jail to return for court appearances.
There are three release options available: release on own recognizance, cash bail, or surety bond.
Release on own recognizance requires a written promise signed by the defendant, saying that they will return on the court date for the court appearance. RORs, as they are commonly shortened to, do not need bail to be posted, and only asks to be promised that under ROR, the defendant will not do any more offenses. However, RORs are only given to less serious cases, and if the petition for an ROR is rejected, only the bail options are then available.
The cash bail option requires the defendant to pay a usually hefty amount of money in full in order to be released. The amount posted will be held by the court, and will be fully returned if the defendant successfully appears on court. The downside is that cash bails are usually exorbitant, thus most people opt for a surety bond.
Requiring only 10% of the bail as premium, surety bonds are arranged by bail bonds agents and companies. This stipend, although a lot cheaper, cannot be reimbursed even if the defendant appears on court. This premium, on another upside, can be paid not just by cash, but also by credit card and collateral, among others, and the agents are then responsible for the defendant. However, at the occasion that the defendant fails to appear, the entire amount which the agents spent, from the court bails to other miscellaneous fees must be paid in full.
