How Does Bail Work in Texas?
Once an individual is arrested for a crime, they are brought to a local law enforcement agency to be booked, a process which lasts 1-2 hours. After given a court date to settle their charges, they are then incarcerated to a jail. Alternatively, they can also choose to be released from jail through posting bail. Bail gives the court an assurance that the defendant will appear on court by giving them an incentive if they return.
There are three release options available: release on own recognizance, cash bail, or surety bond.
To be released on your own recognizance, the defendant needs to sign a written promise that they will appear on court when they are needed to. RORs do not require bail to be posted, and only require the person to promise that under ROR, he will not commit other offenses. The amount posted will be held by the court, and will be fully returned if the defendant successfully appears on court. However, these are costly and expensive; thus, most people opt for a surety bond.
Surety bonds require bail bonds agents, the ones who will do the bail, to be paid a 10% premium. This premium, however, is non-refundable, which serves as a service fee for the bail bonds agents. On the good side, these agents can be paid in a variety of ways, from credit cards to collateral, and they are also responsible for ensuring the defendant appears in court. On the downside, if the defendant fails to appear in court, the entire amount paid by the agents must be covered.
