How Does Bail Work in Texas?
If an individual is caught and arrested for a crime, they are booked at a local law enforcement agency, and the process lasts for 1-2 hours. They are then brought to jail when they are given a court date to settle their charges. Alternatively, they can also choose to be released from jail through posting bail. Bail gives the court an assurance that the defendant will appear on court by giving them an incentive if they return.
There are three release options available: release on own recognizance, cash bail, or surety bond.
Release on own recognizance requires a written promise signed by the defendant, saying that they will return on the court date for the court appearance. RORs do not require bail to be posted, and only require the person to promise that under ROR, he will not commit other offenses. However, RORs are only given to less serious cases, and if the petition for an ROR is rejected, only the bail options are then available.
