How Does Bail Work in Texas?
An individual undergoes a booking process lasting for an hour or two in a local law enforcement in the city if they were arrested for a crime. The booking process gives them a court date to resolve the charges, and before the date, the arrested person will have to be jailed. They are also given an option to be released from jail, with three options readily available, including bail. Bail can be thought of as enticement for a jailed individual to appear in court on the given court date once released.
There are three release options available: release on own recognizance, cash bail, or surety bond.
The first option, release on own recognizance or ROR, requires the defendant to make a written promise to appear on court when he is required to. RORs only need to be assured that the defendant will not commit other offenses under ROR, and do not need bail to be posted. On the downside, RORs are only usually granted to less grave misdemeanors, thus they are only left to post bail.
Cash bails require the defendant to pay a certain amount determined by the judge so that they can be released. This amount is held by the court and then refunded to the defendant if they complete the required court appearances. However, these are costly and expensive; thus, most people opt for a surety bond.
Surety bonds are organized by bail bonds agents for a tenth of the posted bail. This stipend, although a lot cheaper, cannot be reimbursed even if the defendant appears on court. The fee is also payable through credit cards and collateral, among other possible ways, and bail bonds agents are responsible for the defendant to appear on court. If the defendant fails to appear on court on the court date, the entire amount which the agents paid for bail must be paid.
