How Does Bail Work in Texas?
Once an individual is arrested for a crime, they are brought to a local law enforcement agency to be booked, a process which lasts 1-2 hours. They are then brought to jail when they are given a court date to settle their charges. They are given an option to be released from jail, too, commonly by posting bail. Bail is specially designed as an incentive for the individual to appear in court on the assigned court date.
There are three release options available: release on own recognizance, cash bail, or surety bond.
Release on own recognizance requires a written promise signed by the defendant, saying that they will return on the court date for the court appearance. RORs only need to be assured that the defendant will not commit other offenses under ROR, and do not need bail to be posted. RORs, however, are only granted to less serious misdemeanors, and the bail options are the only ones available if the petition for an ROR is rejected.
The cash bail option requires the defendant to pay a usually hefty amount of money in full in order to be released. This amount is held by the court and then refunded to the defendant if they complete the required court appearances. Cash bails, though, cost a lot of money, thus many people choose the surety bond option.
Surety bonds are arranged by bail bonds agents, who require a 10% premium to be paid. The fee is non-refundable, even at the defendant’s complete court appearances. This premium, on another upside, can be paid not just by cash, but also by credit card and collateral, among others, and the agents are then responsible for the defendant. If the defendant fails to appear on court on the court date, the entire amount which the agents paid for bail must be paid.
