How Does Bail Work in Texas?
An individual undergoes a booking process lasting for an hour or two in a local law enforcement in the city if they were arrested for a crime. After given a court date to settle their charges, they are then incarcerated to a jail. They are also given an option to be released from jail, with three options readily available, including bail. Bail is specially designed as an incentive for the individual to appear in court on the assigned court date.
There are three release options available: release on own recognizance, cash bail, or surety bond.
The first option, release on own recognizance or ROR, requires the defendant to make a written promise to appear on court when he is required to. RORs only need to be assured that the defendant will not commit other offenses under ROR, and do not need bail to be posted. However, RORs are only given to less serious cases, and if the petition for an ROR is rejected, only the bail options are then available.
The cash bail option requires the defendant to pay a usually hefty amount of money in full in order to be released. The amount posted will be held by the court, and will be fully returned if the defendant successfully appears on court. However, cash bails are expensive, so most people choose a surety bond.
Requiring only 10% of the bail as premium, surety bonds are arranged by bail bonds agents and companies. The fee is non-refundable, even at the defendant’s complete court appearances. This premium, on another upside, can be paid not just by cash, but also by credit card and collateral, among others, and the agents are then responsible for the defendant. If the defendant fails to appear on court on the court date, the entire amount which the agents paid for bail must be paid.
