How Does Bail Work in Texas?
An individual undergoes a booking process lasting for an hour or two in a local law enforcement in the city if they were arrested for a crime. After given a court date to settle their charges, they are then incarcerated to a jail. However, they can also opt to be released from jail by posting bail, among other release options. Bail can be considered as an incentive for a person released from jail to return for court appearances.
There are three release options available: release on own recognizance, cash bail, or surety bond.
The release on own recognizance option requires the defendant to promise the court to appear if needed by signing a written note. An ROR includes the promise to not commit other offenses, and does not require bail. However, the right to be given an ROR is given when the pre-incarceration interview results allows them so, and if they aren’t allowed, they’re left with the bail options.
Cash bails require the defendant to pay a certain amount of cash in full to the court, before getting released. The cash is held by the court and returned once the defendant has completed his court appearances. However, these are costly and expensive; thus, most people opt for a surety bond.
Requiring only 10% of the bail as premium, surety bonds are arranged by bail bonds agents and companies. This 10% fee is non-refundable, and cannot be returned even after the defendant completes his court appearances, which is how bail bonds agents earn. On the good side, these agents can be paid in a variety of ways, from credit cards to collateral, and they are also responsible for ensuring the defendant appears on court. If the defendant fails to appear on court on the court date, the entire amount which the agents paid for bail must be paid.
