How Does Bail Work in Texas?
In the instance that someone is charged with a crime, a booking process, lasting for around an hour or two, occurs in a local law enforcement, commonly the police department in the city. They are given a date when they can settle their charges, and before then, they are brought to jail. They are also given an option to be released from jail, with three options readily available, including bail. Bail is specially designed as an incentive for the individual to appear in court on the assigned court date.
There are three release options available: release on own recognizance, cash bail, or surety bond.
To be released on your own recognizance, the defendant needs to sign a written promise that they will appear on court when they are needed to. RORs do not require bail to be posted, and only require the person to promise that under ROR, he will not commit other offenses. This stipend, although a lot cheaper, cannot be reimbursed even if the defendant appears on court. This premium, on another upside, can be paid not just by cash, but also by credit card and collateral, among others, and the agents are then responsible for the defendant. If the defendant fails to appear in court on the court date, the entire amount which the agents paid for bail must be paid.
