How Does Bail Work in Texas?
An individual undergoes a booking process lasting for an hour or two in a local law enforcement in the city if they were arrested for a crime. The booking process gives them a court date to resolve the charges, and before the date, the arrested person will have to be jailed. Alternatively, they can also choose to be released from jail through posting bail. Bail gives the court an assurance that the defendant will appear on court by giving them an incentive if they return.
There are three release options available: release on own recognizance, cash bail, or surety bond.
To be released on your own recognizance, the defendant needs to sign a written promise that they will appear on court when they are needed to. RORs, as they are commonly shortened to, do not need bail to be posted, and only asks to be promised that under ROR, the defendant will not do any more offenses. On the downside, RORs are only usually granted to less grave misdemeanors, thus they are only left to post bail.
As the name suggests, cash bails requires cash to be posted as bail to the court. The amount is kept by the court and returned in full once the defendant completes all their court appearances. Cash bails, though, cost a lot of money, thus many people choose the surety bond option.
Surety bonds are organized by bail bonds agents for a tenth of the posted bail. This stipend, although a lot cheaper, cannot be reimbursed even if the defendant appears on court. The fee is also payable through credit cards and collateral, among other possible ways, and bail bonds agents are responsible for the defendant to appear on court. However, at the occasion that the defendant fails to appear, the entire amount which the agents spent, from the court bails to other miscellaneous fees must be paid in full.
