How Does Bail Work in Texas?
An individual undergoes a booking process lasting for an hour or two in a local law enforcement in the city if they were arrested for a crime. They are then brought to jail when they are given a court date to settle their charges. They are also given an option to be released from jail, with three options readily available, including bail. Bail can be considered as an incentive for a person released from jail to return for court appearances.
There are three release options available: release on own recognizance, cash bail, or surety bond.
The release on own recognizance option requires the defendant to promise the court to appear if needed by signing a written note. RORs do not require bail to be posted, and only require the person to promise that under ROR, he will not commit other offenses. On the downside, RORs are only usually granted to less grave misdemeanors, thus they are only left to post bail.
Cash bails require the defendant to pay a certain amount determined by the judge so that they can be released. The amount is kept by the court and returned in full once the defendant completes all their court appearances. Cash bails, though, cost a lot of money, thus many people choose the surety bond option.
Surety bonds require bail bonds agents, the ones who will do the bail, to be paid a 10% premium. The fee is non-refundable, even at the defendant’s complete court appearances. The fee is also payable through credit cards and collateral, among other possible ways, and bail bonds agents are responsible for the defendant to appear on court. If the defendant fails to appear in court on the court date, the entire amount which the agents paid for bail must be paid.
