How Does Bail Work in Texas?
If an individual is caught and arrested for a crime, they are booked at a local law enforcement agency, and the process lasts for 1-2 hours. They are then brought to jail when they are given a court date to settle their charges. They are also given an option to be released from jail, with three options readily available, including bail. Bail gives the court an assurance that the defendant will appear on court by giving them an incentive if they return.
There are three release options available: release on own recognizance, cash bail, or surety bond.
The release on own recognizance option requires the defendant to promise the court to appear if needed by signing a written note. This 10% fee is non-refundable, and cannot be returned even after the defendant completes his court appearances, which is how bail bonds agents earn. On the good side, these agents can be paid in a variety of ways, from credit cards to collateral, and they are also responsible for ensuring the defendant appears on court. If the defendant fails to appear in court on the court date, the entire amount which the agents paid for bail must be paid.
