How Does Bail Work in Texas?
An individual undergoes a booking process lasting for an hour or two in a local law enforcement in the city if they were arrested for a crime. They are then brought to jail when they are given a court date to settle their charges. They are given an option to be released from jail, too, commonly by posting bail. Bail is specially designed as an incentive for the individual to appear in court on the assigned court date.
There are three release options available: release on own recognizance, cash bail, or surety bond.
Release on own recognizance requires a written promise signed by the defendant, saying that they will return on the court date for the court appearance. RORs do not require bail to be posted, and only require the person to promise that under ROR, he will not commit other offenses. However, RORs are only given to less serious cases, and if the petition for an ROR is rejected, only the bail options are then available.
Cash bails require the defendant to pay a certain amount determined by the judge so that they can be released. The amount posted will be held by the court, and will be fully returned if the defendant successfully appears on court. However, these are costly and expensive; thus, most people opt for a surety bond.
Surety bonds are organized by bail bonds agents for a tenth of the posted bail. This 10% fee is non-refundable, and cannot be returned even after the defendant completes his court appearances, which is how bail bonds agents earn. On the good side, these agents can be paid in a variety of ways, from credit cards to collateral, and they are also responsible for ensuring the defendant appears on court. If the defendant fails to appear on court on the court date, the entire amount which the agents paid for bail must be paid.
