How Does Bail Work in Texas?
In the instance that someone is charged with a crime, a booking process, lasting for around an hour or two, occurs in a local law enforcement, commonly the police department in the city. They are then brought to jail when they are given a court date to settle their charges. They are given an option to be released from jail, too, commonly by posting bail. Bail can be thought of as enticement for a jailed individual to appear in court on the given court date once released.
There are three release options available: release on own recognizance, cash bail, or surety bond.
The release on own recognizance option requires the defendant to promise the court to appear if needed by signing a written note. RORs only need to be assured that the defendant will not commit other offenses under ROR, and do not need bail to be posted. However, the right to be given an ROR is given when the pre-incarceration interview results allows them so, and if they aren’t allowed, they’re left with the bail options.
As the name suggests, cash bails requires cash to be posted as bail to the court. The amount posted will be held by the court, and will be fully returned if the defendant successfully appears on court. Cash bails, though, cost a lot of money, thus many people choose the surety bond option.
Surety bonds are organized by bail bonds agents for a tenth of the posted bail. This premium, however, is non-refundable, which serves as a service fee for the bail bonds agents. This premium, on another upside, can be paid not just by cash, but also by credit card and collateral, among others, and the agents are then responsible for the defendant. On the downside, if the defendant fails to appear in court, the entire amount paid by the agents must be covered.
