How Does Bail Work in Texas?
An individual undergoes a booking process lasting for an hour or two in a local law enforcement in the city if they were arrested for a crime. They are then brought to jail when they are given a court date to settle their charges. However, they can also opt to be released from jail by posting bail, among other release options. Bail gives the court an assurance that the defendant will appear on court by giving them an incentive if they return.
There are three release options available: release on own recognizance, cash bail, or surety bond.
Release on own recognizance requires a written promise signed by the defendant, saying that they will return on the court date for the court appearance. RORs only need to be assured that the defendant will not commit other offenses under ROR, and do not need bail to be posted. RORs, however, are only granted to less serious misdemeanors, and the bail options are the only ones available if the petition for an ROR is rejected.
As the name suggests, cash bails requires cash to be posted as bail to the court. The cash is held by the court and returned once the defendant has completed his court appearances. Cash bails, though, cost a lot of money, thus many people choose the surety bond option.
Surety bonds are organized by bail bonds agents for a tenth of the posted bail. The fee is non-refundable, even at the defendant’s complete court appearances. On the good side, these agents can be paid in a variety of ways, from credit cards to collateral, and they are also responsible for ensuring the defendant appears on court. If the defendant fails to appear on court on the court date, the entire amount which the agents paid for bail must be paid.
