How Does Bail Work in Texas?
Once an individual is arrested for a crime, they are brought to a local law enforcement agency to be booked, a process which lasts 1-2 hours. After given a court date to settle their charges, they are then incarcerated to a jail. Alternatively, they can also choose to be released from jail through posting bail. Bail can be thought of as enticement for a jailed individual to appear in court on the given court date once released.
There are three release options available: release on own recognizance, cash bail, or surety bond.
To be released on your own recognizance, the defendant needs to sign a written promise that they will appear on court when they are needed to. An ROR includes the promise to not commit other offenses, and does not require bail. However, RORs are only given to less serious cases, and if the petition for an ROR is rejected, only the bail options are then available.
As the name suggests, cash bails requires cash to be posted as bail to the court. This amount is held by the court and then refunded to the defendant if they complete the required court appearances. However, these are costly and expensive; thus, most people opt for a surety bond.
Requiring only 10% of the bail as premium, surety bonds are arranged by bail bonds agents and companies. The fee is non-refundable, even at the defendant’s complete court appearances. On the good side, these agents can be paid in a variety of ways, from credit cards to collateral, and they are also responsible for ensuring the defendant appears on court. However, at the occasion that the defendant fails to appear, the entire amount which the agents spent, from the court bails to other miscellaneous fees must be paid in full.
