How Does Bail Work in Texas?
In the instance that someone is charged with a crime, a booking process, lasting for around an hour or two, occurs in a local law enforcement, commonly the police department in the city. They are given a date when they can settle their charges, and before then, they are brought to jail. They are given an option to be released from jail, too, commonly by posting bail. Bail can be considered as an incentive for a person released from jail to return for court appearances.
There are three release options available: release on own recognizance, cash bail, or surety bond.
To be released on your own recognizance, the defendant needs to sign a written promise that they will appear on court when they are needed to. RORs do not require bail to be posted, and only require the person to promise that under ROR, he will not commit other offenses. However, RORs are only given to less serious cases, and if the petition for an ROR is rejected, only the bail options are then available.
The cash bail option requires the defendant to pay a usually hefty amount of money in full in order to be released. The amount is kept by the court and returned in full once the defendant completes all their court appearances. Cash bails, though, cost a lot of money, thus many people choose the surety bond option.
Surety bonds are organized by bail bonds agents for a tenth of the posted bail. This premium, however, is non-refundable, which serves as a service fee for the bail bonds agents. This premium, on another upside, can be paid not just by cash, but also by credit card and collateral, among others, and the agents are then responsible for the defendant. On the downside, if the defendant fails to appear in court, the entire amount paid by the agents must be covered.
