How Does Bail Work in Texas?
Once an individual is arrested for a crime, they are brought to a local law enforcement agency to be booked, a process which lasts 1-2 hours. They are then brought to jail when they are given a court date to settle their charges. Alternatively, they can also choose to be released from jail through posting bail. Bail can be considered as an incentive for a person released from jail to return for court appearances.
There are three release options available: release on own recognizance, cash bail, or surety bond.
Release on own recognizance requires a written promise signed by the defendant, saying that they will return on the court date for the court appearance. An ROR includes the promise to not commit other offenses, and does not require bail. RORs, however, are only granted to less serious misdemeanors, and the bail options are the only ones available if the petition for an ROR is rejected.
Cash bails require the defendant to pay a certain amount determined by the judge so that they can be released. This amount is held by the court and then refunded to the defendant if they complete the required court appearances. However, these are costly and expensive; thus, most people opt for a surety bond.
Surety bonds require bail bonds agents, the ones who will do the bail, to be paid a 10% premium. This stipend, although a lot cheaper, cannot be reimbursed even if the defendant appears on court. This premium, on another upside, can be paid not just by cash, but also by credit card and collateral, among others, and the agents are then responsible for the defendant. On the downside, if the defendant fails to appear in court, the entire amount paid by the agents must be covered.
