How Does Bail Work in Texas?
In the instance that someone is charged with a crime, a booking process, lasting for around an hour or two, occurs in a local law enforcement, commonly the police department in the city. They are given a date when they can settle their charges, and before then, they are brought to jail. They are also given an option to be released from jail, with three options readily available, including bail. Bail can be thought of as enticement for a jailed individual to appear in court on the given court date once released.
There are three release options available: release on own recognizance, cash bail, or surety bond.
The release on own recognizance option requires the defendant to promise the court to appear if needed by signing a written note. RORs only need to be assured that the defendant will not commit other offenses under ROR, and do not need bail to be posted. RORs, however, are only granted to less serious misdemeanors, and the bail options are the only ones available if the petition for an ROR is rejected.
As the name suggests, cash bails requires cash to be posted as bail to the court. The amount posted will be held by the court, and will be fully returned if the defendant successfully appears on court. However, these are costly and expensive; thus, most people opt for a surety bond.
Requiring only 10% of the bail as premium, surety bonds are arranged by bail bonds agents and companies. The fee is non-refundable, even at the defendant’s complete court appearances. This premium, on another upside, can be paid not just by cash, but also by credit card and collateral, among others, and the agents are then responsible for the defendant. However, at the instance that the defendant fails to appear, the entire amount costed by the bail bonds agent for bail must be paid.
