How Does Bail Work in Texas?
An individual undergoes a booking process lasting for an hour or two in a local law enforcement in the city if they were arrested for a crime. They are given a date when they can settle their charges, and before then, they are brought to jail. They are given an option to be released from jail, too, commonly by posting bail. Bail gives the court an assurance that the defendant will appear on court by giving them an incentive if they return.
There are three release options available: release on own recognizance, cash bail, or surety bond.
Release on own recognizance requires a written promise signed by the defendant, saying that they will return on the court date for the court appearance. An ROR includes the promise to not commit other offenses, and does not require bail. However, RORs are only given to less serious cases, and if the petition for an ROR is rejected, only the bail options are then available.
The cash bail option requires the defendant to pay a usually hefty amount of money in full in order to be released. The amount posted will be held by the court, and will be fully returned if the defendant successfully appears on court. However, cash bails are expensive, so most people choose a surety bond.
Requiring only 10% of the bail as premium, surety bonds are arranged by bail bonds agents and companies. This 10% fee is non-refundable, and cannot be returned even after the defendant completes his court appearances, which is how bail bonds agents earn. On the good side, these agents can be paid in a variety of ways, from credit cards to collateral, and they are also responsible for ensuring the defendant appears on court. On the downside, if the defendant fails to appear in court, the entire amount paid by the agents must be covered.
