How Does Bail Work In Texas?
Once an individual is arrested for a crime, they are brought to a local law enforcement agency to be booked, a process which lasts 1-2 hours. They are given a date when they can settle their charges, and before then, they are brought to jail. However, they can also opt to be released from jail by posting bail, among other release options. Bail gives the court an assurance that the defendant will appear on court by giving them an incentive if they return.
There are three release options available: release on own recognizance, cash bail, or surety bond.
The release on own recognizance option requires the defendant to promise the court to appear if needed by signing a written note. RORs do not require bail to be posted, and only require the person to promise that under ROR, he will not commit other offenses. On the downside, RORs are only usually granted to less grave misdemeanors, thus they are only left to post bail.
As the name suggests, cash bails requires cash to be posted as bail to the court. The cash is held by the court and returned once the defendant has completed his court appearances. However, cash bails are expensive, so most people choose a surety bond.
Requiring only 10% of the bail as premium, surety bonds are arranged by bail bonds agents and companies. This stipend, although a lot cheaper, cannot be reimbursed even if the defendant appears on court. This premium, on another upside, can be paid not just by cash, but also by credit card and collateral, among others, and the agents are then responsible for the defendant. However, at the occasion that the defendant fails to appear, the entire amount which the agents spent, from the court bails to other miscellaneous fees must be paid in full.
